relocation case? How have other courts interpreted that case? How has the case
law evolved since that case was decided? How has it evolved with the revisions to
the IMDMA? Are there any conflicts in the case law of the various Illinois
Appellate Districts regarding what the importance of each factor or how each
factor should be applied to varying facts?
2. Dissipation: What is the controlling statutory law? What is the definition of
dissipation? How, if at all, has the definition or application of dissipation
changed over time (i.e., with the revision of the IMDMA)? What are some
examples of what courts consider to be dissipation? What is the effect of
dissipation in an overall dissolution case? Are there any conflicts in the case law
of the various Illinois Appellate Districts regarding what does and does not
constitute dissipation?
3. Grandparent visitation: What is the controlling statutory law? What are the
most important cases that have been decided on the issue? How has Illinois law
evolved based on the court decisions that have been made and the recent revision
of the IMDMA? What is the current status of a grandparent’s right to visitation?
4. Embryos: What is the current law regarding possession/ownership/custody of
embryos that are preserved during a marriage? Who gets them upon divorce? Is
it a custody issue or a property issue? What factors have to be considered?
5. Anonymous sperm donors: What is the current law regarding the ability to seek
child support from an anonymous sperm donor? About the rights of an
anonymous sperm donor to pursue paternity, custody, visitation, or other rights
with regard to a child born from such a donation? What other issues have been
raised with the courts dealing with anonymous sperm donation, and how have
the courts decided those issues?2
