Pick ONE type of trust (from : fixed, discretionary or resulting).
Select at least THREE cases for the selected type of trust and critically evaluate how the case law has developed that type of trust.
In your answer, your analysis should include consideration of, inter alia,:-
• Cases we cover in this module
• The extent to which the selected cases developed the existing state of the law; AND
• The extent to which the decisions were controversial and gave rise to academic debate
One of the assessment criteria will be the extent to which you have integrated your discussion of the cases you chose into a single legal analysis. Marks will not be awarded simply for a description of the facts of a particular case.
