Bayer believed the findings of the EPA and were certain they did not produce a harmful product. In each case regarding Roundup, the jury sided with the plaintiff because proof is an elusive concept. Clearly, in the jury’s view, there was sufficient “proof” for the case against Roundup. Yet, it is close to impossible to prove in cancer cases. Science proves one thing and law proves another. In product liability cases like these, plaintiffs must prove that the product was the “specific cause” of the harm done. Therefore, I side with the defendant. I stand behind the science and research.

Non-Hodgkin’s lymphoma, a cancer affecting the immune system, occurs when the body produces excessive abnormal lymphocytes, a kind of white blood cell. Eventually, lymph nodes become crowded by these cancerous lymphocytes and begin to swell. Certain infections, bacteria, and medications, as well as older age, are all well-documented risk factors of non-Hodgkin’s lymphoma. I am siding with the defendant that the use of round up was not the cause of their cancer diagnosis. Studies in the past had shown that glyphosate has no reported link to cancer and since the lawsuit against Monsanto, the chemical is now seen as a cancer-causing agent.

Scientists believe that it is the interaction of many factors together that produces cancer.
