Description
Jas works around 40 hours a week doing food deliveries on behalf of a corporation called Moober Eats. He has a bicycle and a backpack, provided by Moober Eats with its logo. For around 10 hours a week, Jas also does work on behalf of a corporation called Just Drink, for which he has another bag. In both cases, Jas logs onto an app on his phone and accepts delivery orders when they come up. Moober Eats work comes up more often. Both apps have required that he ticks a box saying ‘I accept the terms’, and these terms state that Jas:
(a) is an independent contract,
(b) can provide a suitably qualified substitute to carry out an order at any time, and
(c) must not decline three rides in a row, or will be logged off the app.
Jas is logged onto both apps for 10 hours each day, five days a week. His total average pay is around £7 an hour including the time he waits for orders to come up, but his average pay for the time spent delivering once he has accepted orders is £9 an hour.
Jas has also organised a union with his fellow cyclists, and they are seeking statutory recognition.
